The competition between two of the world's largest obesity drugmakers has arrived in court.
Novo Nordisk filed suit against Eli Lilly, alleging that Lilly used outdated data in advertising to support the claim that its products were more effective than Wegovy, Novo Nordisk's weight-loss treatment.
The Danish company characterizes those advertisements as "deliberately false." What the complaint says The accusation is specific: Eli Lilly did not merely shade a comparison but, Novo Nordisk alleges, reached for data it knew was no longer current to make a superiority case against Wegovy.
That distinction matters legally. Aggressive comparative advertising is one thing. Choosing stale evidence to construct a superiority claim is a harder position to defend.
